State density laws allow cities to require density projects mitigate safety risks: LINKHowever, cities only have 30-60 days to provide a list of safety issues that must be mitigated once an application is submitted.

3/26/24: PVE contracted to develop Objective Standards for density projects LINK. While cosmetics are the focus of the standards, we remain hopeful that safety elements will be included. Fingers crossed. Density projects without adequate Safety standards are a danger to us all.

Q1: What is the cost of the city’s Tree Inventory? LINKThus far, the cost is $200,000 LINK The tree count is 20,500 for all trees on city owned land.
Q2: The city newsletter states that the city will provide 20 feet of fire abatement trimming. LINK LA County Fire requires a 200’ barrier to keep our homes safe.Did the city contract to have the rest of the 200’ barrier trimmed next year? No. The city contracted for 3 years to re-trim the first 20 feet each year. LINK

Q3: How was the Housing Element zoning derived? Was PreservePVE involved?April version released at 5/10/23 meeting: Councilmembers Roos and Kemps, as an adhoc committee, proposed: LINK (88th page) City Hall, some of Malaga Cove Plaza, Lunada Bay Patio building, St. Francis Church July version published 8/12/23: CMs Roos and Kemps proposed: City Update LINK (87th page) some of MC Plaza, all of LB commercial buildings. Discussed at 9/13/23 Town hall. Town hall on 2/8/24: the Council unanimously approved rezoning: LB Patio Building, some of MC Plaza and the Church of Science. LINK PreservePVE does not rezone land. Zoning is conducted by Council. PreservePVE advocates for good governance practices of community engagement and residential approval before rezoning Open Space.

Q4: Is voter approval required to rezone Open Space for the Housing Element?Yes. Source: 2/7/24 City Staff report LINK (slide 17) states: “A rezone of any Open Space property must be approved by a simple majority of the voters of the city voting “YES” on a ballot measure proposing the zone change at a general or special municipal election.” Prior to the PVE Land Preservation Act, Open Space unprotected by parkland CC&Rs could be rezoned and/or sold at anytime by Council. This placed some locations to be at risk such as PV Dr West, PV Dr North and Paseo Lunado medians, which have no parkland protection. This is too significant a decision to be based solely on the vote of three elected representatives and now requires voter approval.

Q5: What is PreservePVE’s position on development?Development significant enough to change the rural character of the city should require resident support. Governance should be driven by the will of the people.

Q7: How much would it cost taxpayers to develop a new Civic Center with density housing, new administrative offices and new Police and Fire Stations?The city has not estimated this effort, nor affirmed this is desired or needed. The cost would be considerable and need to include: - Developing temporary facilities for Admin, Police and Fire - Transferring to and from these temporary facilities - Developing the Civic Center with density housing, Admin offices, Police and Fire stations Since these are not revenue generating functions, residents will need to pay substantially higher taxes for these new facilities.

Q8: Has the Fire Department stated their facilities are lacking and/or improvements would improve their safety services?No. The Fire Dept is not seeking upgrades, has not indicated any improvements are needed or any safety services are lacking.
